Rental Fee Breakdown

Insurance may be required by Company policy depending on vessel type. A credit card authorization hold between $500 and $5,000 is required depending on vessel type. Funds are released after return inspection, less any documented damage charges or unpaid rental charges.

These terms summarize the business conditions that apply before payment and booking confirmation. They are separate from the operator waiver, which must be completed by each operator before pickup or through the Company's e-sign process.

Booking, Pricing & Availability

All bookings are subject to availability, operator eligibility, payment verification, weather, and safe operating conditions.
The Company reserves the right to confirm, decline, cancel, or modify a rental where availability, safety, insurance, payment, or operator eligibility requirements are not met.
Listed rates, delivery fees, insurance charges, taxes, deposits, and optional add-ons are subject to final written confirmation before the booking is complete.

Operator Eligibility & Safety

Operator age limits are Company insurance and operator-policy requirements and may vary by vessel type.
Proof of competency may be required depending on vessel type and applicable Transport Canada regulations. Motorized rentals may require a PCOC, another accepted proof of competency, or a completed Rental Boat Safety Checklist for the rental period where permitted.
The renter is responsible for ensuring that all listed operators and passengers follow safety instructions, capacity limits, local rules, and Company policies.
The Company reserves the right to cancel or modify rentals for safety reasons at any time.

Deposit, Authorization Hold & Charges

A credit card authorization hold between $500 and $5,000 applies depending on vessel type.
Funds are released after return inspection when the vessel and equipment are returned on time, with agreed fuel level, and without documented damage or unpaid charges.
Deductions apply only for documented damages, missing equipment, fuel, late-return fees, cleaning charges where applicable, or other unpaid charges under the confirmed rental terms.

Cancellation, Weather & Force Majeure

Cancellations more than 30 days before rental may be subject to a $300 charge or 25% of the rental total, with the remainder credited as stated in the booking confirmation.
Cancellations 7-30 days before rental may convert the booking deposit to account credit, valid according to the confirmed booking terms.
Cancellations within 48-72 hours may be non-refundable except where the Company agrees otherwise in writing.
Weather-related cancellations may be rescheduled or adjusted at the Company's discretion when safe operation is not possible.
The Company may cancel, delay, or modify rentals because of unsafe conditions, mechanical issues, government orders, emergency events, or other circumstances outside reasonable control.

Privacy & Personal Information

The Company collects personal information for booking administration, safety screening, payment processing, insurance, damage claims, regulatory compliance, and rental communication.
Personal information is collected, used, retained, and disclosed only for stated purposes or as otherwise permitted by law, in accordance with the Company's Privacy Policy.
Optional marketing consent, including promotional photo consent, is separate from booking consent and may be declined without cancelling the booking request.

Responsibility & Limitation of Liability

The renter is responsible for operating the vessel safely, following instructions, supervising passengers, returning equipment on time, and paying agreed charges.
The Company is responsible for providing the confirmed vessel and required safety equipment in rental-ready condition, subject to availability and safety conditions.
To the extent permitted by law, the Company's liability is limited to direct losses caused by the Company's ordinary negligence related to the rental service and excludes indirect, consequential, or speculative losses.
Nothing in these terms limits liability that cannot be limited under applicable Canadian law.

Governing Law & Dispute Resolution

Unless a different province is stated in the final booking confirmation, these terms are governed by the laws of Ontario and the applicable federal laws of Canada.
The parties will first try to resolve disputes in good faith through written notice and discussion. If unresolved, disputes may be brought before the courts or legally available dispute forum in the applicable province, subject to non-waivable consumer rights.

Separate Operator Waiver

Risk Acknowledgment & Limited Release

This waiver is intended to be signed separately by each operator at pickup or through an e-sign process. It is not completed merely by submitting the booking request.

Acknowledgment of Risk

I understand that operating or riding on watercraft involves inherent risks, including changing weather, cold water, waves, collisions, falls, equipment malfunction, operator error, injury, drowning, or other serious harm. I agree to follow safety instructions, capacity limits, navigation rules, rental boundaries, and Company directions.

Operator Representations

I confirm that I am physically capable of participating, I know how to swim, I am not impaired by alcohol, cannabis, medication, fatigue, or any substance affecting safe operation, and I will stop operating if conditions become unsafe.

Limited Release

To the maximum extent permitted by Canadian law, I release the Company and its owners, employees, agents, and contractors from claims arising from ordinary negligence related to my rental use of the watercraft and equipment. This release does not apply to gross negligence, wilful misconduct, fraud, or any liability that cannot be excluded or limited under applicable law.

Renter Responsibility

I understand that I remain responsible for my conduct, passenger conduct, unsafe operation, breach of rental instructions, damage to equipment, third-party property damage, fines, unpaid charges, and other responsibilities stated in the confirmed rental agreement.
